The following is important information regarding the Terms and Conditions of Service which apply to your hosting account with Program Development Labs.  Please read this document carefully for a full understanding of our policy and possible suspension or termination of your account.

General
Existing and future users agree to the following terms of service.

Definitions
PDL, Hosting Company, Company, Provider or We = Program Development Labs
Customer, User or Client = you; client of Program Development Labs
Account, Package = hosting plan purchased with Program Development Labs

Content restrictions
Client agrees that all files uploaded onto PDL’s servers will not violate laws in any country. Examples of unacceptable uses include: adult content displaying any model less than 18 years of age (for some localities/countries this may be 21), illegal MP3's or any other media files, IRC bots or/and servers, copyright infringement, trademark infringement, warez, cracks, serial numbers. Program Development Labs will be the final arbiter as to what constitutes a violation of this policy.

SPAM
PDL will not tolerate SPAM, originating from customer accounts. Use of your account as a source of SPAM will lead to immediate account suspension. Program Development Labs reserves the right to terminate any account without prior notice upon indication of SPAM activity.

Bandwidth Usage
Program Development Labs reserves the right to suspend user's account in case of high server resource usage or/and bandwidth usage. Account can be unsuspended by contacting PDL.

Excessive Server Resources Usage
Resources are defined as bandwidth and/or processor and memory utilization. Any account using more than 15% of the server for period of time longer than 60 seconds will be suspended and customer will be notified. There are a lot of problems that could cause excessive server usage: improperly configured CGI scripts, SQL databases, etc. This policy is implemented in extreme circumstances and intended to avoid server misuse.

Account Cancellation/Termination
To cancel an account, you need to provide PDL with written notification outlining reason for cancellation.. Funds will be refunded in amount of unused month(s) on your balance. Complete refund will be provided if customer requests refund within 5 days from subscription date.  There will be no refunds made in the case of terms of service violations

Provider uptime guarantee
PDL’s  network of servers will have guaranteed aggregate average uptime of 99.9% for each three month period. The uptime guarantee, however, excludes scheduled servers/network maintenance, upstream network (backbone) provider problems, or natural disasters.

Payments
Customer agrees to provide PDL with complete and accurate payment details. Use of false information (i.e. stolen credit cards/bank accounts) will be reported to appropriate authorities and account termination without notice.

Security
All users agree to use best efforts to protect their account access information (username and password). You agree that you will not try to decompile or disassemble or otherwise alter any executable code, contents or materials located on the company's servers.

Hack attempts
Client, found hacking or attempting to hack in any way, will be terminated immediately without refund.

Use of compiler and developer libraries located on the server
Users agree to use compilers located on the servers and to compile only legitimate code. Attempts to compile so called exploits or any other type of code that can harm the operation of the server, will lead to account termination. Developer libraries and related files, located on the server or placed by any means into your account, should be used only to compile/create/run legitimate binaries.

3rd party software/scripts
PDL does not guarantee that 3rd party software or/and scripts will run on your account. Clients are to install and support any 3rd party scripts on their own.

IP address allocation for shared hosting customers
Customer may request up to 1 additional IP address on his/her account. Every requested IP must be justified by Customer.  No IP may be used to support illegal activities. Legitimate examples of IP address usage include: Anonymous FTP server, SSL secured site, etc.

Modifications to this document
Program Development Labs reserves the right to modify this document at any time
